"USER"/"MEMBER" TERMS OF USE for PASSPORT CAREER By logging onto the Passport Career ("PC") website, and by using, posting or in any other way accessing information on the PC website, or participating in Passport Career's on-line "Get Connected" community, PC message boards, PC forums, PC webinars, PC networking events and any other content or program made available through the PC website (all collectively referred to as "PC Site Content"), every user hereby agrees as follows. 1. All users ("Users") are subject to the Terms of Use signed and ratified by the Subscribers to PC ("Subscribers"). 2. All PC Site Content material is copyrighted by PC. No user is authorized to copy or reproduce any part thereof. 3. Users cannot share their password. If PC becomes aware that a password is being shared, it has the right to cancel such password and discontinue service to the User in question until PC has resolved the situation with the Subscriber to the satisfaction of PC. 4. As information is continually changing, PC does not take responsibility for the accuracy of PC Site Content, including, but not limited to, materials related to work permits. 5. Links on the PC Site are for the convenience of the User only. Such links are to website maintained by third parties; PC cannot assure or guarantee their accuracy or function. 6. User is wholly responsible for any content posted on the PC. Any criminal or civil liability related to any such content shall be borne by the User. 7. The "Get Connected" community (social network and discussion forum) is exclusively for career and life transition purposes and not to be used for other purposes. Any inappropriate comments will be deleted and continued misuse by User may result in User being terminated. 8. User may close his/her account at any time by emailing us at info@passportcareer.com. 9. PC shall be authorized to provide to Subscriber the following information for each User: names; email addresses; company affiliation and location. Unless compelled at law, PC shall not disclose additional User information to Subscriber. 10. As a member of the "Get Connected" social network, User agrees to make their information visible to other members in the "Get Connected" community. User understands and agrees that any information posted by User on the "Get Connected" Community shall be available to all other users. PC is not responsible for the use or dissemination by any User of information posted on the "Get Connected" community. 11. Access by the User shall be determined by the agreement between PC and Subscriber. Subscriber can discontinue / deny access to any User. Subscriber can order PC to discontinue access to a User at any time. PC will follow Subscriber's instructions concerning access. User shall have no cause of action against PC related to its access. For questions concerning access, contact Subscriber. 12. IN NO EVENT WILL PC BE RESPONSIBLE FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO THE USE BY USER OF THE PC SITE CONTENT (INCLUDING WITHOUT LIMITATION ANY DAMAGES ATTRIBUTABLE TO LOST REVENUES, LOST PROFITS, LOSS OF BUSINESS OR LOSS OF DATA) REGARDLESS OF WHETHER PC WAS ADVISED, HAD OTHER REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY, PC'S MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE USE OF THE PC SITE CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY SUBSCRIBER TO PC UNDER THE AGREEMENT. 13. PC HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, (INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT) WITH RESPECT TO THE PC SITE CONTENT, THE PC SITE, THE CUSTOM ENTRY PAGE, OR THE ACCURACY, FUNCTIONALITY, PERFORMANCE OR RESULTS OF USE OF THE REPORTS, THE PC SITE, OR THE CUSTOM ENTRY PAGE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PC DISCLAIMS ANY WARRANTY THAT THE PC SITE AND THE CUSTOM ENTRY PAGE WILL FUNCTION WITHOUT INTERRUPTION OR THAT THE REPORTS, THE PC SITE, AND THE CUSTOM ENTRY PAGE ARE ERROR-FREE. To the extent that a warranty may not as a matter of applicable law be disclaimed, the scope of such warranty will be the minimum permitted under such law.
